Does Michigan No-Fault Apply in an Uber Accident?
The application of Michigan No Fault Insurance to Uber accidents has been an area of scrutiny since the advent of Uber and Lyft in Michigan. It wasn’t until December 21, 2016, that Michigan passed ride-sharing bills extending the protections of No Fault Insurance to passengers and driver in an Uber accident setting.
Michigan Uber Law ~ Ridesharing Act
Under the Michigan Ridesharing Act, Uber is required to have third party automobile liability with a minimum limit of $1,000,000 for all bodily injury or property damage during the transport of passengers in Michigan. When the Uber driver is simply “logged on” to Uber without a passenger, Uber is required to have “[r]esidual third party automobile liability insurance” of $50,000/person for death or bodily injury and $100,000/incident for death or bodily injury, and $25,000.00 for property damage.
Under both circumstances, Uber is required to hold automobile insurance that covers No Fault Personal Injury Protection (PIP) and Proportion Property Protection (PPI). It is important to note that coverage exclusions are available for personal automobile insurance providers under MCL 500.3017, whereby an authorized insurer may exclude coverage for any loss or injury stemming from an Uber accident. In essence, Uber drivers are excluded from enjoying no-fault insurance benefits afforded by a personal auto policy when involved in an Uber accident in Michigan.
Are Passengers Insured in an Uber Accident?
If you as a passenger are injured in an Uber vehicle, you may only collect No Fault PIP benefits, like wage loss benefits and medical expense reimbursements, from Uber or the Uber driver’s automobile insurer only if you have no other source of No Fault benefits. This is what is referred to as Michigan’s No Fault Order of Priority.

What Safety Requirements are Required of Uber in Michigan?
Uber is required to conduct annual background checks of each of their drivers’ criminal history and obtain driving records. In addition, Uber is prohibited from hiring drivers that (a) are under nineteen years of age; (b) that have had more than four (4) moving violations or one (1) major violation in the prior three years up to the date of application; (c) that have been convicted of a felony within five years prior to the application; (d) that are listed on the National Sex Offender Registry database; (e) that do not have a valid driver’s license issued under the Michigan Vehicle Code or by another state; and (f) you do not provide proof of automobile liability insurance.
Also, Uber vehicles that are 5 years or older must be annually inspected by a licensed mechanic. Michigan law also mandates a zero-tolerance policy in effect for Uber drivers relating to the use of drugs or alcohol while operating an Uber and transporting passengers.
